Who we are
EUCart is operated by EUCART LTD, a company registered in England and Wales with company number 17455065 (registered office address as recorded at Companies House). References to “EUCart”, “we”, “us” and “our” in these Terms mean EUCART LTD. You can contact us at info@eucart.co.uk.
These Terms and Conditions govern your use of our website, application, products, and services. By accessing or using our services, you agree to be bound by these Terms and Conditions.
EUCart operates as a marketplace connecting independent shops with customers. We do not own, stock, or take physical possession of any products listed on our platform — each order is a transaction between you and the shop, which is responsible for fulfilling it. Delivery is carried out on our behalf by Stuart, an independent third-party courier service. All payments are processed securely by Stripe; EUCart does not access or store your card or bank account details.
1. Use of Our Services
You agree to use our services only for lawful purposes and in accordance with these Terms. You must not use our services in any way that could damage, disable, overload, or impair the service, or interfere with another person’s use of it.
You are responsible for ensuring that any information you provide is accurate, complete, and up to date.
2. Accounts
Where an account is required, you are responsible for maintaining the confidentiality and security of your account credentials and for activity carried out through your account.
You must notify us promptly if you believe your account has been accessed or used without your permission.
We reserve the right to suspend or terminate accounts that breach these Terms, misuse the service, or present a security risk.
3. Intellectual Property
All content, software, designs, graphics, logos, trademarks, documentation, and other materials made available through our services are owned by us or our licensors unless otherwise stated.
You may not copy, reproduce, distribute, modify, sell, license, reverse engineer, or commercially exploit our content or services without prior written permission, except where permitted by law.
4. User Content
Where you upload, submit, store, or otherwise provide content through our services, you remain responsible for that content.
You confirm that you have the necessary rights and permissions to provide such content and that it does not infringe the rights of any third party or breach applicable law.
5. Availability
We aim to provide a reliable service but do not guarantee that our services will always be available, uninterrupted, secure, or error-free.
We may modify, suspend, restrict, or discontinue any part of the service where reasonably necessary, including for maintenance, security, operational, or legal reasons.
6. Fees and Payments
Where services are provided for a fee, applicable prices and payment terms will be displayed or agreed before purchase.
You are responsible for paying all charges associated with your purchase or subscription in accordance with the applicable payment terms.
7. Cancellations and Refunds
Cancellation and refund rights will depend on the product or service purchased and any applicable consumer protection laws.
Nothing in these Terms is intended to limit any statutory rights that cannot legally be excluded or restricted.
Age-restricted products
Some shops on EUCart sell alcohol and other age-restricted products. You must be 18 or over to order them. The shop is the licensed seller of these products; EUCart takes your payment on the shop’s behalf. The courier or the shop will ask for photo ID at handover and will not hand over age-restricted products to anyone who cannot show they are 18 or over. If handover is refused for this reason the products are returned to the shop, the price of the products is refunded to you and the delivery fee is not refunded.
8. Limitation of Liability
To the fullest extent permitted by law, we will not be liable for indirect or consequential losses arising from your use of, or inability to use, our services.
Nothing in these Terms excludes or limits liability where doing so would be unlawful, including liability for death or personal injury caused by negligence, fraud, fraudulent misrepresentation, or any other liability that cannot legally be excluded.
9. Third-Party Services
Our services may contain links to or integrations with third-party websites, applications, or services. We are not responsible for the availability, content, security, or practices of third-party services.
In particular, we use Stripe to process payments and Stuart to provide delivery services. Your use of these third-party services is subject to their own terms and privacy practices.
10. Privacy
Personal information collected through our services will be handled in accordance with our applicable privacy policy and data protection obligations.
11. Suspension and Termination
We may suspend, restrict, or terminate access to our services where you materially breach these Terms, misuse the service, fail to make required payments, create a security risk, or where we are required to do so by law.
12. Changes to These Terms
We may update these Terms from time to time to reflect changes to our services, business practices, or legal requirements.
Where appropriate, we will provide reasonable notice of material changes.
13. Governing Law
These Terms and Conditions are governed by the laws of England and Wales.
Any disputes arising in connection with these Terms will be subject to the jurisdiction of the courts of England and Wales, subject to any mandatory rights you may have under applicable consumer law.
